PRIVACY AND DATA PROTECTION

Eyetok respects and protects the privacy of our Users and of third parties.

The User must read and accept this Privacy and Data Protection policy for using the EYETOK Services.

Privacy

In accordance with this policy and the EYETOK Terms of Use, the User undertakes to respect the privacy, intimacy, reputation or personal image of third parties and other Users regarding the Contents and materials used, generated, broadcasted or communicated through the Services.

The User undertakes not to make any broadcasts, recordings or disclosures of any videos or other Contents in which identifiable individuals appear, without their express consent.

In the case of minors, the User must obtain the express consent of the legal guardians of the minor in order to record, broadcast, communicate or store Contents in which minors appear.

In any case, excluded are those appearances which, in accordance with prevailing legislation, do not imply any interference with intimacy, privacy or personal image, such as the accidental non-identifiable appearances of persons, personalities of public relevance in public spaces, etc.

In particular, the User undertakes not to record, broadcast or store Content through the Services:

  1. Offending the intimacy, privacy or personal image of others.

  1. Which, particularly, goes against the rights of minors.

  1. Which is derogatory, offensive, racist, homophobic or obscene.

  1. Which is pornographic or erotic.

  1. Which is inappropriate in accordance with social uses and customs.

EYETOK offers Users and any persons affected a procedure for the Notification of Infringements for reporting and withdrawing Contents which are unlawful or which infringe the Terms and this Privacy policy.

Data Protection

EYETOK gathers data from Users in order to provide them with the Services. The process of their data of a personal nature is only for this purpose: providing a service to the Users.

The data of a personal nature of the Users EYETOK gathers and uses are those necessary for registering with EYETOK and the provision of Services, such as: user name, name and surname, date of birth, gender, email, geographic location or post code, photos or personal images and the geolocation of persons and Users.

EYETOK gathers such data of a personal nature in the registration process of future Users, and in contact forms or through emails sent by interested parties to the email contact address of EYETOK.

In the event the future User should not wish to provide the information and data of a personal nature personal mentioned above, they may not access the Services of EYETOK or be considered a User. In such case, they may only browse the web of www.eyetok.com.

In accordance with the provisions of prevailing legislation on Data Protection, EYETOK hereby informs you of the existence of a computer file containing data of a personal nature entitled “EYETOK USERS”, duly registered with the competent Data Protection authorities (in Spain the Spanish Data Protection Agency), at the responsibility of EYETOK, the purpose of which is to manage and maintain the relationship with its Users.

Consent of Users to the use of their personal data

The User is hereby informed that the use of the Services implies their consent to the collection and processing of their data of a personal nature (pursuant to the provisions of this Privacy policy), including your consent to the transfer of this information to other countries for its storage, treatment and use by EYETOK, including countries which do not afford a level of Data Protection similar to that contemplated by regulations of the European Union.

Before registering and becoming a User of the Services, the future User must read this policy on Privacy and the Protection of Personal Data and accept it by ticking the box on the EYETOK registration form or through any equivalent procedure established, where applicable.

Users rights

Users have the possibility of exercising, in accordance with the provisions of Data Protection regulations, the rights to access, rectification, cancellation and opposition, in respect of their data used by EYETOK, by writing to EYETOK at C/ Ca l’Alegre de Dalt, 55-57, local 4º 1ª, 08024 Barcelona, attaching a photocopy of their national identity card or alternative documentation proving their identity.

We likewise make available to Users the address privacy@eyetok.com for exercising the said rights, notwithstanding the fact that EYETOK may ask them to send information or a copy of their national identity card by post.

EYETOK undertakes to comply with its secrecy obligation regarding any data of a personal nature and its duty to keep them, even after the contractual relationship has terminated, adopting the safety measures imposed by prevailing legislation to avoid their unauthorised access, alteration, loss or treatment.

Communicating of data to third parties

The User accepts and gives his consent to EYETOK communicating their data of a personal nature to third parties, Third-Party Entities, partners or collaborators of EYETOK, so they might communicate directly with the Users and send them information and advertising in relation to the activities and services of such third parties. An example of these cases are Third-Party Entities which have opened a Channel with EYETOK of which the User forms a part, to which it subscribes and in which it participates. In such cases, the User accepts that such Third-Party Entity responsible for the Channel may access their data of a personal nature and send them information relating to their activities, products and services.

CHANNEL” is understood as meaning: a channel within EYETOK, managed by a Third-Party Entity, registered with EYETOK, and which, with its authorisation, uses the Contents for broadcasting, communication and storage, through the EYETOK Services or through a television channel, webpage or any multimedia format other than EYETOK.

Advertising

The User grants their consent to EYETOK sending them advertising relating to EYETOK products or services, and advertising relating to products and services of third parties related to the EYETOK Services.

Should they not wish to receive advertising information, the User may communicate this by writing to unsubscribe@eyetok.com or by changing the settings of their User account.

Cookies

EYETOK may use cookies when a User browses the web www.eyetok.com or other webs related to the Services.

Any cookies which may be used on the web and the Services are only associated with the browser of a specific computer and do not provide per se the name or surname of the User.

Thanks to the cookies, it is possible for EYETOK to recognise the browsers of the Users after they have registered for the first time, without having to register on every visit in order to access the areas and Services reserved exclusively for them.

The cookies can not read the cookie files created by other providers. Users have the possibility of configuring their browsers to receive an on-screen warning of cookies being received and to prevent the installation of cookies on their hard disk. Please see the instructions and handbook of your browser for further information.

In order to use the Services, it is not necessary for the User to allow the installation of the cookies sent by EYETOK, notwithstanding the fact that in such case it will be necessary for Users to register each time they access a service requiring prior registration.

The cookies used in the Services may be used by EYETOK, in which case they may be used from the various servers operated by the latter, or from the servers of certain third parties providing us with their services and using the cookies on behalf of EYETOK (such as, for example, cookies used for advertising or certain Contents making the User view advertising or certain Contents at a time, on a number of occasions and in a manner which are all predetermined).

Any third-party advertisers placing advertisements on the Services may use "hit counters" or "web beacons" in their advertisement, in order to analyse the efficiency of their advertising. Providing they have not activated the option preventing the installation of cookies on your hard disk, Users may explore their hard disk following the instruction handbook and help of their operating system for further details on each server from where the cookies or web beacons are sent.
